Ordinance No. 002 of 2022
AN ORDINANCE TO PROVIDE FOR THE APPOINTMENT OF THE
VILLAGE CLERK AND VILLAGE TREASURER.

THE VILLAGE OF BEULAH ORDAINS:

Section 1. Establishment of Offices.
As authorized by Section 1(3), Chapter II of Act 3 of the Public Acts of 1895, as amended, being MCL 62.1(3), the offices of village clerk and village treasurer with the duties as described in Chapter IV of Act 3 of the Public Acts of 1895 and such other duties as established by the Village Council shall be chosen by nomination of the Village President and appointment by a majority of the Village Council.

Section 2. Current Term.
The expiration of the current term of the elected village clerk is November 19,2024, or when the office is vacated, whichever occurs first. The expiration of the current term of the elected village treasurer is November 19, 2024, or when the office is vacated, whichever occurs first.

Section 3. Term of Office.
The term of office of the first village clerk and village treasurer nominated and appointed under this ordinance shall not commence until the expiration of the Current Term as set forth in Section 2 and shall be indefinite. The term of office of any subsequent village clerk and village treasurer shall commence as directed by the Village Council and shall be indefinite. The individual(s) appointed to be the village clerk and village treasurer shall serve at the pleasure of the Village Council and may be removed at will of the Village Council when the Village President considers it to be in the public interest.

Section 4. Qualifications:
The village clerk and village treasurer need not be a resident of the Village but must not be in default to the Village and must within 30 days of appointment subscribe the respective oaths of office and file them with the village clerk, together with the filing of any bond required by law.

Section 5. Compensation.
The village clerk and village treasurer shall receive such compensation as the Village Council shall determine on an annual basis, with the amount to be fixed by resolution. Such compensation shall not be decreased as to the monetary amount to be received for the full performance of duties during the year the resolution is in effect. The compensation may be increased or decreased on an annual basis at the time the Village Council establishes compensation by resolution.

Section 6. Effective Date.
This ordinance shall take effect 45 days after the date of its adoption, unless a petition signed by not less than ten percent (10%) of the registered electors of the village is filed with the village clerk within such 45 from the date of its adoption. If a petition is filed within such period of time, this ordinance shall then take effect only upon its approval at the next general village or special village election held on the question of whether the ordinance shall be approved. Notice of the delayed effect of this ordinance and the right of petition under this section shall be published separately at the same time and in the same manner as the ordinance or a notice of the ordinance is published in a local newspaper of general circulation.

Section 7. Severability.
If any section, provision or clause of this ordinance or the application thereof to any person or circumstance shall be invalid, such invalidity shall not effect any remaining portion or application of this ordinance which can be given effect without the invalid portion or application.
